The United States Attorney for the Southern District of New York and the Federal Bureau of Investigation signed a non-prosecution agreement today with Optimal Group Inc in exchange for cooperation regarding illegal gambling transactions.
Optimal, is a Canadian based company traded on the NASDAQ, and was once responsible for processing online payments between customers and merchants. An investigation found that between 2004 and 2006 Optimal processed more than $3 billion in transactions for Internet gaming merchants, of which more than 80 percent or $2 billion were from customers in the United States.
Optimal has acknowledged that the Internet gambling merchants violated federal criminal law by offering gambling in the U.S; however they did not withdrawal their services until the Unlawful Internet Gambling Enforcement Act was signed into law.
Optimal has agreed to forfeit approximately $19.2 million worth of proceeds earned from these transactions, to the United States Government. In exchange for the restitution and continued cooperation of the company the government has agreed not to prosecute.
