A federal investigation attempting to prosecute online casinos for conducting illegal gambling operations has called for a U.S. District Judge to arrest a 10th person for refusal to testify before a grand jury.

Earlier this year Nichalas Zicarelli was called before the grand jury to testify against an online gaming operation that he had been a patron of. At that time, Zicarelli invoked his firth amendment right and was granted immunity from prosecution. On Monday, Judge Greg Kays found him in contempt for lack of cooperation and sentenced him to jail for 18 months or until he agreed to testify.

Assistant U.S. Attorney Paul Becker commented that “A law-abiding citizen has to make a decision, Do I obey the law, or do I protect my bookmaker?” in an argument that the grand jury has the right to hear evidence about violations of U.S. Law.

While Zicarelli is the 10th person jailed for similar circumstances in the governments fight to prosecute online betting organizations, Judge Kays is responsible for three other arrest in this case.

Those jailed for refusing to testify that they took part in online betting could be released prior to the end of their sentence if they agree to testify, the grand jury completes its inquiry or if the grand jury completes its term.
