A 2008 lawsuit filed against the state of Idaho by a couple who say they became compulsive gamblers and lost thousands of dollars, their home and jobs by playing at the casino has no merit.

The Idaho Supreme Court issued a unanimous ruling on Friday to uphold a lower courts decision to dismiss the lawsuit.

The suit alleged that the gaming machines violate the Idaho Constitution’s prohibition on gambling and was calling for the removal of the devises from the Fort Hall Casino.

The casino is operated by the Shoshone-Bannock Tribes is located on tribal property. The state’s voters approved Tribal gaming in a ballot initiative in 2001.

The Seventh District Judge, Darren Simpson dismissed the suit, ruling the Idaho couple lacked standing.
