The San Pasqual Band of Mission Indians in north San Diego county has filed a lawsuit in the Las Angeles Superior Court against the state of California to recoup $115 million in lost revenue.
The tribe claims that revenue was lost during a five year battle over licensing additional slot machines at the Valley View casino and that the state and Governor Arnold Schwarzenegger acted in bad faith and interfered with tribal business.
Last year a federal judge ruled in favor of the tribe who challenged the state’s interpretation of the 1999 gambling compact.
The former Governor Gray Davis set a limit on the number of slot machines Indian tribes could license based on a complicated formula.
Since then tribes were not allowed to add additional slot machines without signing new compacts that meant making bigger payments to the state.
However the recent ruling granted the tribe permission to add 428 more slot machines, for a total of 2,000.
A lawyer for the tribe said, “It’s our lost revenue. We should have had those machines years ago.”
