The Supreme Court ended nearly a five year battle today between the Prairie Meadows racetrack and casino and a banned patron, Troy Blackford.
The Iowa casino had withheld more than $9,000 in winnings from Blackford in 2006 after discovering that he had been issued a permanent “trespass ban” nearly ten years earlier for damaging a slot machine.
Blackford pleaded guilty to criminal mischief for his actions and was fined by a court of law. In 1998 he was again removed from the casino and fined after pleading guilty to trespassing.
In 2006 Blackford was wagering on a slot machine at the casino when he hit the jackpot.
The casino confiscated the winnings and Blackford filed a petition against the casino to recover damages.
A Polk County district court ruled in favor of the casino, however Blackford appealed.
The Iowa Court of Appeals reversed the ruling and ordered a new trial saying it found no statutory provision allowing the casino to confiscate the winnings.
The casino appealed to the Iowa Supreme Court, who ruled that the casino “had the authority to withhold winnings from a person who had been involuntary excluded.”
Blackford’s attorney said they were disappointed in the court’s ruling.
