A three year legal battle aimed at preventing the Scotts Valley Band of Pomo Indians from building a casino on San Pablo Bay continues despite Judge’s ruling.

The First District Court of Appeal in San Francisco overturned a lower court’s ruling that the city of Richmond should have prepared an environment review before entering into an agreement in 2006 agreeing to provide roadwork, public safety services and political support in exchange for annual payments from the casino.

The Parchester Village Neighborhood Council and the Citizens of East Shore Parks is behind the lawsuit filed against the city in 2007.

The latest ruling reinstated the 20 year agreement between the tribe and the city and add that the city isn’t required to perform such an analysis because it’s not the regulatory body.

The city would not receive the $330 million unless the casino was built.

However before the 225,000 square foot casino including 2,000 slot machines and 50 gambling tables could be built in the unincorporated area just north of Richmond, Scotts Valley must receive federal approval to transfer the acreage into Indian land.

At which time the justices said Richmond must prepare an environmental review if it decides to build or relocate public works to accommodate the casino.

Stephan Volker, the attorney for the neighborhood and environmental groups that challenged the agreement, says he will appeal.
