Missouri Gaming Commission Told To “Review” Decision

Late last year the Missouri Gaming Commission issued a resolution that Pinnacle Entertainment may not repair, replace or relocate the aging Admiral riverboat, which hosts the President Casino without a new gambling license.

The company appealed in September requesting judicial review of the decision.

On Tuesday the Missouri Court of Appeals returned a verdict that remanded the dispute back to the commission for “further proceedings appropriate for whatever action affecting Pinnacle’s license and/or hull the Commission decides to take.”

Pinnacle argued that the decision preventing repairs to the riverboat resulted in the recent vote by the commission to revoke the President Casino’s gaming license for financial “underperformance” after repeated flooding-related closures and increased competition from its sister casino Lumiere Place.

“While neither party fully convinces this court of its position, the confusion regarding what the resolution attempts to accomplish raises concern that this was a contested case without sufficient process,” the court found in a unanimous decision.

It is unclear if regulators will reverse their decision to close gambling operations at the President Casino on July 1, pending “further review” or if the court’s decision came to late.
