The legal battle between the Rincon Indian band and California’s Governor Arnold Schwarzenegger continues, although the Rincon’s made headway this week.
“It does provide us a level of insurance,” said lawyer Scott Crowell.
The tribe won an appeal case initiated by the Governor’s office when Magistrate Judge William McCurine ruled this week that the statewide slots limit under the compact signed in 1999 should be 56,000.
McCurine also ruled in an earlier case that Schwarzenegger negotiated in bad faith with the tribe by demanding payments for the state’s general fund.
Last year a Fresno judge ruled that the Governors cap of 32,000 was to low and that there should be 42,000.
With Fresno’s ruling and the decision that the state issue more licenses the Harrah’s casino in North County purchased the additional slot machines.
The state has vowed to appeal both of McCurines rulings.
