Casino operator Pinnacle Entertainment has agreed to remedy a federal complaint filed with the National Labor Relations Board in St. Louis by employees and their union, UNITE HERE Local 74.
The lawsuit alleged that the gaming company was “interfering with, restraining, and coercing employees” in the exercise of their rights guaranteed under federal law at its President Riverboat Casino and Lumiere Place Casino after refusing to negotiate with employees and their union in May 2009.
The charges alleged unlawful withdrawal of recognition and failure to bargain, unilateral changes in working conditions, failure to grant wage increases, and improper terminations. Terms of the settlement call for Pinnacle to reinstate with back pay and interest employees who the NLRB alleged were wrongly fired and compensate employees for changes in working conditions that the NLRB alleged it had wrongly refused to negotiate.
The settlement was reached just days before the matters were scheduled to go to trial.
UNITE HERE International Vice President and Missouri state director Tim Luebbert said, “It shouldn’t take a federal case to get the Company to honor its promises. We hope this unprecedented settlement signals the Company is ready to address its remaining unmet promises to the people of Missouri.”
