A lien has been filed against developer Michael Moldenhauer and Horse Racing at Raton LLC for failure to pay nearly $845,000 in construction costs for the planned, yet delayed, racetrack and casino in the north New Mexico community of Raton.
On April 12, Franken Construction Co. Inc files the lien with the Colfax County clerk, listing unpaid invoices in March and April totaling $844, 678 plus interest.
The lien is the latest issue in a series of problem facing the racino.
A month after racing commissioners approved horse racing, The New Mexico Gaming Control Board authorized a casino license for the planned $50 million track last June.
However the Racino which was to have a 1 mile oval track with slot machines, a lounge and entertainment areas remains unfinished as Moldenhauer continues to miss a number of self-imposed deadlines including the opening of a temporary casino.
