Last year the Australian Government seized a touch screen computer with internet access from a Melbourne pub as a suspected illegal gambling devise.

Several months later, the makers, VenueNet, is seeking the courts to issue an order for the machine to be returned since charges have not been filed.

VenueNet’s chairman, John Thompson says that the delay has cost his company millions of dollars as plans to install 200 machines in the eastern states have been stalled until the issue was resolved. He said that he was considering seeking compensation.

While the maker of the computer kiosks has an agreement with a sports betting company, Sportsbet, to provide access to Sportsbet’s website and other services through the device, the issue tests the outdated gambling regulations of the Victorian Government in an internet age claiming their product is no different than any other computer and does not in itself accept or record bets.

A magistrate is due to hear arguments in the case from Sportsbet on Tuesday however the Victorian Commission for Gambling Regulation lodged an appeal to prevent the case from being heard as a third party in the case, on legal issues relating to the seizure warrant.
