Pennsylvania’s state Treasurer Rob McCord has filed a lawsuit against the states’ Gaming Control Board this week seeking a court order affirming his right to attend the board’s public and private meetings.
Ongoing disagreements with the board over the role his office should play in the regulation of the states’ casino industry led to the suit.
McCord claims that state law designates him or his designee as an “ex officio” member of the board and entitles him to the all the privileges of regular board members except voting.
However he says he has been discouraged from participating in meetings and closed door executive sessions.
The gaming board claims that McCord has been invited to the meetings, as long as he agrees to sign non-disclosure agreements and adheres to the same code of ethics and confidentiality standards that board members do.
“While we are mystified by the tack he is taking, we are confident in our interpretation of the gaming act and our insistence that the treasurer abide by the same rules applicable to all other board members to (ensure) the proper administration of legalized gaming,” spokesman Doug Harbach said.
