The California Supreme Court unanimously denied a request to review an agreement between the city of Richmond and an Indian tribe attempting to gain approval to build a casino.
The agreement was first challenged by the neighborhood council of Parchester Village and by East Bay environmental groups in 2008, when a Superior Court judge ruled that the city should have conducted an environmental study before approving the plan, ending the pact.
However, the First District Court of Appeal in San Francisco reinstated the agreement in February with a 3-0 ruling. The Court of Appeals said that the agreement should be upheld, as Richmond is not responsible to conduct the survey since the casino is not in Richmond, but in an unincorporated area.
The Tribe will be required by the state and federal government to conduct its own environmental study while seeking approval.
The agreement in question was reached in 2006, when the city agreed to provide police, firefighting and other municipal services to the Scotts Valley Band of Pomo Indians in exchange for nearly $330 million over 20 years, if they win federal approval to build a casino with 2,000 slot machines and 50 gambling tables on the property.
