A New Jersey State Legislator has filed a lawsuit saying that the current Professional and Amateur Sports Protection Act is unconstitutional based on the provision that the ban allows sports betting in some states and does not in others.
In an effort to boost state revenue, NJ State Senator Raymond Lesniak contends that legalized sports gambling could generate as much as $100 million a year.
“Sports betting in the U.S. is unregulated, untaxed and illegal,” said Lesniak. “Rather than supporting thousands of jobs, economic activity and tourism, the federal ban supports offshore operators and organized crime.”
Currently, sports betting now is only conducted in Nevada; however, Delaware, Oregon and Montana are exempt from the federal ban.
If Lesniak wins his plight and can get the ban overturned, he would propose legislation allowing authorized sports betting online, at casinos, racetracks and off-track betting establishments.
“Our casinos are suffering, our racetracks are dying and the state budget needs revenues,” Lesniak said.
