Earlier this week, a Washington State Appeals Court upheld the state’s position on Internet poker by rejecting a challenge to the law forbidding online gambling.

In a unanimous decision, the appeals court rejected Lee Rousso, a lawyer in Washington as well as the Poker Players Alliance state director, and his plea to have the online gambling laws lifted.

Washington law states that it is a felony for people to play online poker.

Rousso’s major argument was that a 2006 law that forbids Internet gambling in the state directly violates the U.S. Constitution and it’s clause that gives the federal government the right to regulate interstate commerce.

The State Of Washington feels that it is in the best interests of their citizens to be protected from the ills that are associated with gambling and the three Appeals Court judges ruled the regulation or gambling outweighs the burdens on interstate commerce.

Rousso did find some positives that came out of the ruling and is poised to take the case to the State Supreme Court.

“I was encouraged that the court accepted my argument that Congress has not given the states unambiguous authority to regulate Internet gambling,” Rousso said. “That was a big point of dispute in this case.”
