A federal appeals court judge has granted an expedited appeal sought by the four major sports leagues and the NCAA, allowing their lawyers to argue in front of a three-judge panel that Delaware shouldn’t be allowed to begin legalized sports betting on September 1st.
Lawyers representing Major League Baseball, the NFL, NHL, NBA, and the NCAA are arguing that Delaware’s venture into single-game and parlay sports betting violates the Professional and Amateur Sports Protection Act of 1992.
“The court made clear it wants to move quickly to resolve these issues, which is fine,” said Brian Selander, a spokesman for Delaware Gov. Jack Markell. “We look forward to our day in court.”
Delaware had parlay betting for one year in 1976 and only took parlay bets on the NFL. The leagues argue that Delaware should not be allowed to take single-game bets and bets on sports other than the NFL.
The State hopes that revenue collected by sports betting will help Delaware’s cash starved economy. Governor Markell had proposed an expansion of the state’s gambling laws in hopes of raising an estimated $55 million in taxable revenue.
