According to a federal appeals court, Delaware’s sports betting plan is in violation of a federal prohibition against sports gambling.
A three-judge panel of the Third Circuit Court of Appeals decided that the new law violates a 1992 federal ban on sports gambling.
The Delaware legislation had been challenged by the NFL, NBA, NHL, Major League Baseball and the NCAA in a lawsuit.
Because Delaware had previously conducted multi-game “parlay” bets on football games in 1976, the state felt it was exempted from the federal ban on sports gambling known as the Professional and Amateur Sports Protection Act.
Delaware is one of four states that had sports gambling prior to the ban enacted in 1992. Congress provided exceptions for Nevada, Oregon and Montana; permitting them to continue with the sports betting they already had in place.
Lawyers for the professional leagues and the NCAA had maintained that the Delaware legislation was indeed illegal because the state was planning to offer single-game betting for the first time.
The leagues argue that single-game betting could lead fans to question the integrity of their games.
